Privacy policy

COMS ("COMS," "we," "us," or "our") operates this store and website, including all related information, content, features, tools, products, and services (the "Services"), to provide you with a curated shopping experience. Our Services are powered by Shopify, which enables us to run our store and process your orders.

This Privacy Policy explains how we collect, use, and disclose your personal information when you visit, use, or make a purchase through the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

By using or accessing any of the Services, you acknowledge that you have read and understood this Privacy Policy.

1. Personal Information We Collect

"Personal information" means information that identifies or can reasonably be linked to you. It does not include information that has been anonymized or de-identified so that it can no longer be linked to you. Depending on how you interact with us, we may collect:

  • Contact details — name, billing and shipping address, phone number, email address.
  • Financial information — payment card details, financial account information, transaction details, and payment confirmations. (Card numbers are processed directly by our payment processor and are not stored on our own systems.)
  • Account information — username, password, security questions, preferences, and settings.
  • Order and transaction information — items viewed, added to cart or wishlist, purchased, returned, exchanged, or cancelled, and your order history.
  • Communications — anything you tell us directly, such as customer support inquiries or product feedback.
  • Device and usage information — browser type, device identifiers, IP address, and how you interact with our site (pages viewed, links clicked, time spent).
  • Cookies and similar technologies — we and our service providers use cookies, pixels, and similar tools to keep your cart working, remember your preferences, understand site traffic, and, where permitted, personalize marketing. You can control cookies through your browser settings; blocking some cookies may affect site functionality. See Section 8 for more on advertising cookies specifically.

2. Where We Get This Information

  • Directly from you — when you create an account, browse or purchase from our store, or contact us.
  • Automatically — through your use of the Services and through cookies and similar technologies.
  • From our service providers — including Shopify and other vendors who process data on our behalf.
  • From partners or other third parties — for example, shipping carriers confirming delivery, or fraud-prevention services.

3. How We Use Your Information

  • To provide and improve the Services — process payments, fulfil and ship orders, manage your account, handle returns and exchanges, enable product reviews, and personalize your shopping experience (e.g., recommending related products).
  • Marketing and advertising — with your consent where required, we may send marketing emails or texts and show you ads based on your activity on our site, which you can opt out of at any time (Section 7).
  • Security and fraud prevention — authenticate accounts, secure payments, and detect or investigate suspicious activity. You're responsible for keeping your login credentials confidential.
  • Customer support — respond to your questions and maintain our relationship with you.
  • Legal compliance — comply with applicable law, respond to valid legal requests, and enforce our terms and policies.

4. How We Disclose Your Information

We disclose personal information only where necessary, including to:

  • Shopify and other service providers who support our operations — e.g., payment processing, fulfilment and shipping, IT hosting, analytics, and customer support.
  • Marketing and advertising partners, to the extent you have not opted out (Section 7). These partners use your information under their own privacy policies.
  • Third parties you direct us to, such as when you use a social login or ask us to ship to a third party.
  • Our affiliates, within our corporate group.
  • In a business transaction, such as a merger, sale, or bankruptcy.
  • As required by law, including to respond to subpoenas or similar legal process, or to protect the rights, property, or safety of COMS, our customers, or others.

We do not sell your personal information for money. Depending on where you live, certain sharing for advertising purposes may be considered a "sale" or "share" under local law — see Section 7 for how to opt out.

5. Our Relationship with Shopify

Our store is hosted on Shopify, which processes personal information on our behalf to provide and improve the Services. Shopify may also use aggregated or de-identified data from interactions across its merchants, including our store, to provide platform-wide features (e.g., fraud prevention, analytics). For details on how Shopify handles this data, see the Shopify Consumer Privacy Policy. Depending on where you live, you may be able to exercise certain rights directly through the Shopify Privacy Portal.

6. Children's Data

Our Services are not directed to, and are not intended for use by, children under the age of majority in their jurisdiction. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us using the details in Section 12 and we will delete it.

7. Your Rights and Choices

Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may be subject to exceptions.

  • Access / know what personal information we hold about you.
  • Delete personal information we hold about you.
  • Correct inaccurate personal information.
  • Portability — receive a copy of your information, or have it transferred to a third party, in certain circumstances.
  • Opt out of the sale or sharing of your personal information, or of its use for targeted advertising, where applicable.
  • Manage marketing preferences — unsubscribe from promotional emails at any time using the link in those emails. You may still receive non-promotional messages, such as order confirmations.

Global Privacy Control: if you visit our site with the Global Privacy Control signal enabled, we will treat this as an opt-out request for the browser and device you're using, and will apply it to your account where we're able to link the signal to one. We do not currently respond to other "Do Not Track" browser signals.

New Zealand: if you are in New Zealand, you have rights under the Privacy Act 2020 to access and request correction of personal information we hold about you. You can also complain to the Office of the Privacy Commissioner if you believe we have not handled your information properly.

UK / EEA: if you are located in the UK or European Economic Area, you may also have the right to object to or restrict certain processing, and to withdraw consent at any time where we rely on consent (this does not affect the lawfulness of processing carried out before withdrawal).

To exercise any of these rights, contact us using the details in Section 12. We may need to verify your identity before processing your request, and you may designate an authorized agent to act on your behalf, subject to proof of authorization.

8. Advertising Cookies

Some cookies on our site support personalized advertising — for example, showing you ads for products you've viewed, on our site or elsewhere. Where required by law, we will ask for your consent before setting these cookies, and you can withdraw that consent at any time through our cookie settings or the opt-out link in Section 7.

9. Security and Retention

No method of transmission or storage is completely secure, and we cannot guarantee perfect security. Please avoid sending sensitive information to us through unsecured channels.

We retain personal information for as long as reasonably necessary for the purposes described in this policy — for example, to maintain your account, provide the Services, comply with legal or tax obligations, resolve disputes, and enforce our agreements.

10. International Transfers

We and our service providers may store and process your personal information outside the country where you live, including in the United States and other jurisdictions where Shopify or our vendors operate. Where we transfer personal information out of the UK or EEA, we rely on recognized safeguards, such as the European Commission's Standard Contractual Clauses or the UK's equivalent, unless the destination country is already recognized as providing an adequate level of protection.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal or operational reasons. We will post the revised policy on this page and update the "Last updated" date above. Where required by law, we will provide additional notice of material changes.
